Our
policies.
A consolidated statement of the terms, privacy practices, cancellation principles and website-use policies applicable to this website and the professional services of SHETH ASSOCIATES, subject to the engagement terms applicable to each client matter.
Website terms & conditions
These Terms of Use govern access to and use of the SHETH ASSOCIATES website, its pages, digital resources, enquiry facilities and related online services (collectively, the “Website”). By accessing, browsing or otherwise using the Website, you acknowledge that you have read and understood these Terms and agree to comply with them.
Use of the Website
Users should provide accurate information when submitting an enquiry and should not knowingly provide misleading, unlawful, defamatory, fraudulent or infringing material. The Website may be used only for lawful purposes and in accordance with applicable Indian law.
No automatic advocate-client relationship
Accessing the Website, sending an enquiry, communicating by email or WhatsApp, or downloading material does not by itself create an advocate-client relationship. A professional relationship arises only after the firm has expressly accepted the engagement, completed any required conflict and suitability checks, and the applicable engagement terms have been agreed.
Website information
Legal information published on the Website is general and educational in nature. Laws, regulations, procedural requirements and judicial interpretations may change. No content should be treated as a substitute for advice on the particular facts, documents, limitation position, jurisdiction and objectives of an individual matter.
Intellectual property
The Website's text, visual identity, logo, graphics, layout, original materials and other content are proprietary to SHETH ASSOCIATES or are used with permission. Except as permitted by law, no material may be reproduced, republished, commercially exploited or distributed without prior written permission.
Third-party links
The Website may contain links to external websites or resources for convenience. SHETH ASSOCIATES does not control those third-party resources and their respective terms and privacy practices may apply independently.
Changes and force majeure
SHETH ASSOCIATES may modify these policies or Website content when required by law, professional requirements, operational changes or security considerations. The firm shall not be responsible for delay or non-performance caused by circumstances beyond reasonable control, subject to applicable law.
Governing law and jurisdiction
These Website terms are governed by the laws of India. Subject to applicable law and the terms of any specific client engagement, disputes relating to Website use shall be subject to the competent courts having jurisdiction at Rajkot, Gujarat.
Privacy policy
SHETH ASSOCIATES respects the privacy of visitors, prospective clients, existing clients, professional contacts and other persons who communicate with the firm. This policy describes how information received through the Website may be collected, used, retained and protected, subject to applicable law.
Information that may be collected
Depending on how you interact with the Website, information may include your name, telephone number, email address, organisation details, location, the nature of your enquiry and information that you voluntarily provide in communications. Website infrastructure may also generate technical information such as IP address, browser type, device information, access time and basic server logs.
Purpose of processing
Information may be used to respond to enquiries, communicate with you, understand the nature of a proposed matter, assess whether the firm may be able to assist, administer an accepted professional engagement, maintain appropriate records, protect the Website, comply with legal obligations and prevent fraud or misuse.
Disclosure
Information may be shared where reasonably necessary for professional, administrative, technical or legal purposes, including with service providers supporting website hosting, communications or information technology, or where disclosure is required or permitted by law, court order or lawful governmental process.
Security
Reasonable safeguards may be used to protect information from unauthorised access, disclosure, alteration or destruction. However, no internet transmission or electronic storage system can be guaranteed to be completely secure. Highly sensitive or privileged documents should not be sent through an unsecured web form.
Retention and deletion
Information may be retained for as long as reasonably necessary for the purpose for which it was collected, for the administration or defence of legal claims, for professional and statutory record-keeping obligations, or as otherwise required or permitted by law. Requests concerning access, correction or deletion may be made through the contact details on the Website, subject to applicable legal and professional retention requirements.
Consent and communications
Where consent is the applicable legal basis, you may withdraw consent by contacting the firm. Withdrawal will not necessarily affect processing already undertaken lawfully or processing that is necessary for legal, contractual or professional purposes.
Refund & cancellation policy
Legal services are professional services and are not equivalent to the sale of physical products. Cancellation and refund questions are therefore determined by the nature and stage of the professional engagement, the work already undertaken and the written fee or engagement terms applicable to the matter.
Cancellation of an enquiry or consultation
A request to cancel or reschedule an appointment should be made as early as reasonably possible through the firm's contact channels. Where professional time has already been reserved, work has commenced, drafting has been undertaken, or an appointment has been substantially performed, any refund or adjustment will be considered in accordance with the applicable fee terms.
Work already performed
Fees attributable to professional work already completed, including consultation, legal research, drafting, document review, appearances, conferences or other agreed services, may not be refundable to the extent permitted by applicable law and the engagement terms.
Refunds, where applicable
Where a refund is approved, it will ordinarily be processed through the original or an appropriate payment channel within a reasonable administrative period, subject to payment-provider processing and verification requirements.
Separate engagement terms
A signed engagement letter, fee agreement, invoice, written quotation or other matter-specific arrangement may contain more specific provisions. In case of a conflict, the applicable matter-specific professional terms shall govern to the extent legally permissible.
Return / exchange policy
SHETH ASSOCIATES does not ordinarily sell physical products through this Website. Accordingly, product return, replacement and exchange provisions are not applicable to professional legal services.
If a digital document, report or other deliverable is subject to a correction because of a demonstrable administrative or formatting error attributable to the firm, the appropriate corrective action may be considered according to the circumstances and the applicable engagement terms. This does not create a general right to a refund or replacement of professional work.
Delivery / shipping policy
Physical-product shipping is not a service offered through the SHETH ASSOCIATES Website. Legal services, opinions, notices, drafts and other professional deliverables may be communicated electronically, in person, through agreed courier/postal channels or by another method agreed with the client.
Where a document is sent through a third-party courier, postal service, email provider or other communication infrastructure, delays attributable to that third party may be outside the firm's control. The parties may agree on specific delivery arrangements for a particular engagement.
Professional engagement policy
Acceptance of matters
Submission of an enquiry does not guarantee acceptance of a matter. The firm may assess factual circumstances, legal issues, jurisdiction, conflicts of interest, professional considerations, availability and other relevant factors before accepting an engagement.
Client information
Clients and prospective clients are expected to provide complete and accurate material facts and documents relevant to the matter. The firm may rely upon information supplied by the client unless circumstances reasonably require independent verification.
Communication
Routine communications may take place by telephone, email, WhatsApp or other agreed channels. Electronic communications should not be assumed to be privileged or secure until the professional relationship and an appropriate communication protocol have been established.
Professional fees
Professional fees, expenses, court fees, statutory charges, travel, documentation and other disbursements, where applicable, shall be governed by the fee arrangement agreed for the relevant matter. The Website does not constitute a fixed quotation unless expressly stated.
Confidentiality & privileged material
SHETH ASSOCIATES treats client information with appropriate professional care and confidentiality, subject to applicable law, professional obligations, lawful disclosure requirements and the circumstances of the particular engagement.
Prospective clients should avoid sending highly confidential, privileged or strategically sensitive material through the public Website until the firm has confirmed an appropriate channel for communication and any necessary conflict checks have been undertaken.
Website & legal information disclaimer
Nothing on this Website constitutes a guarantee of a particular legal outcome. Past experience, professional profiles, descriptions of practice areas and general legal commentary do not predict the result of any future matter.
Availability of a particular remedy, forum, proceeding or representation depends on the facts, evidence, limitation, jurisdiction, applicable legislation, procedural requirements and other circumstances of the individual matter.
For the complete professional disclaimer, please also refer to SHETH ASSOCIATES' Disclaimer page.
Questions, requests & grievances
Questions concerning these policies, privacy requests, correction requests, cancellation matters or other Website-related concerns may be communicated through the firm's official contact channels.
